These Terms of Service (the "Terms") are an agreement between you and Starchive LLC, a California limited liability company registered to do business in New York, doing business as Starchive ("Starchive", "we", "us", "our"). They apply to starchive.la, our online store, customer accounts, our New York City showroom and appointments, purchases, seller and consignor submissions, and related services (the "Services").

By using the Services or placing an order, you agree to these Terms and to the policies they refer to: our Privacy Policy, Return Policy, and Shipping Policy. If you do not agree, please do not use the Services.

Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live, to place an order, submit an item, or create an account. Accounts are optional. If you create one, you are responsible for keeping your sign-in details secure and for activity under your account. Please tell us promptly if you believe your account has been used without your permission.

Our Pieces

Starchive sells pre-owned, vintage, and one-of-a-kind luxury clothing and accessories. Unless a listing says otherwise, every piece has been previously owned and may show signs of wear.

• We describe and photograph the condition, size, and details of every piece as accurately as we can. Condition grades, measurements, circa dates, materials, and colors are our good-faith assessment.
• Colors may look different depending on your screen. Sizing varies by brand and era, so please check the measurements on each listing.
• We are happy to send additional photos, measurements, or a video before you buy. Email hello@starchive.la or message us on Instagram or WhatsApp.

Starchive is an independent reseller. We are not affiliated with, authorized by, or endorsed by the brands whose pieces we sell. Brand names and trademarks belong to their owners and are used only to identify the pieces.

Authenticity

Every piece we sell is inspected and authenticated by Starchive before it is listed. If a piece you bought from us is ever shown not to be authentic, by the brand or a recognized third-party authentication service, we will refund the full price you paid as described in our Return Policy. This guarantee does not expire.

Prices and Availability

• Prices are listed in US dollars and may change at any time before you place an order.
• Most pieces are one of a kind and may also be offered in our showroom or on other resale marketplaces. A piece can sell elsewhere before your order is confirmed. If that happens, we will cancel the order and refund you in full.
• If a price, description, or other detail is listed in error, we may correct it and cancel any affected order, even after you have received an order confirmation. We will refund any amount you paid for a cancelled order.
• Estimated shipping, tax, and totals shown in the cart are estimates. The final amount is shown at checkout.

Orders

Your order is an offer to buy. An order confirmation email confirms that we received your order; it does not mean we have accepted it. We accept your order when we ship it. We may refuse, limit, or cancel any order, including to prevent fraud, to verify payment or identity, or where a piece is unavailable or listed in error. If we cancel an order after you have paid, we will refund you in full.

To protect our clients and our inventory, orders may be reviewed by our fraud-prevention providers. We may ask you to verify your identity, billing address, or payment method before an order ships.

Payment and Financing

We accept payment online through Shopify Payments, Shop Pay, PayPal, and Afterpay. Monthly payment options through Shop Pay Installments are provided by Affirm. In our showroom we may also accept cash, Zelle, PayPal, and cryptocurrency.

Financing and buy-now-pay-later options are offered and approved by the provider, not by Starchive, and are subject to that provider's terms, eligibility, and credit approval. Monthly payment amounts shown on our site are estimates. Your actual rate and payments depend on the provider's decision at checkout.

Taxes and Duties

We collect sales tax where we are required to. For orders shipping outside the United States, prices do not include import duties, taxes, or customs fees. These are set by the destination country, are charged by the carrier on delivery, and are the responsibility of the buyer, as described in our Shipping Policy.

Shipping and Delivery

Orders ship as described in our Shipping Policy. Every package is insured for its full value while in transit. Once the carrier marks a package as delivered to the address you provided, responsibility for the package passes to you. Please check your shipping address carefully at checkout.

Returns and Refunds

Returns are accepted within 7 days of delivery for store credit only, as described in our Return Policy, which also covers our lifetime authenticity guarantee, pieces that arrive damaged, wrong, or not as described, and any cancellation or return rights you have under the law where you live, including the 14-day right of withdrawal for orders shipped to the European Union.

Disputes and Chargebacks

If something is wrong with your order, please contact us at hello@starchive.la before contacting your bank or card issuer, so we can resolve it quickly under our Return Policy. If a chargeback is filed, we may provide order, delivery, and communication records to the payment provider to respond to it.

Showroom and Appointments

Our New York City showroom is open by appointment. The showroom location is shared with your appointment confirmation. Please keep it private and do not share it publicly. We may decline, reschedule, or end an appointment at our discretion, including for safety or security reasons. Purchases made in the showroom are subject to these Terms and our Return Policy.

Selling and Consigning with Starchive

When you offer an item to Starchive for sale or consignment, you confirm that you own it, that you have the right to sell it, and that, to the best of your knowledge, it is authentic and accurately described.

• Submitting an item does not create an obligation for either of us. Any offer we make is subject to inspecting and authenticating the item in person.
• We do not accept counterfeit items. We may decline any item for any reason.
• Consignments are governed by a separate written consignment agreement, which controls if it conflicts with these Terms.
• Photographs you submit are used privately to evaluate and administer your submission and are not displayed publicly unless we agree otherwise with you.

Communications

By placing an order, booking an appointment, or contacting us, you agree that we may contact you by email, telephone, text message, or WhatsApp about your order, appointment, submission, or request. We send marketing emails and texts only with your consent, and you may opt out at any time as described in our Privacy Policy.

Our Content

The photographs, text, descriptions, graphics, and design of the Services are owned by or licensed to Starchive and are protected by copyright and other laws. You may view and share links to our pages for personal use. You may not copy, reproduce, or reuse our photographs or listing content, including on other marketplaces or websites, without our written permission.

Acceptable Use

You agree not to:

• Use the Services for any unlawful or fraudulent purpose, including placing orders with stolen or unauthorized payment methods
• Provide false or misleading information
• Scrape, crawl, or use automated tools to collect content, prices, or data from the Services
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services, accounts, or our systems
• Upload or transmit viruses or other harmful code
• Harass, threaten, or abuse our staff, clients, or others

We may suspend or end your access to the Services if you violate these Terms.

Third-Party Services

The Services rely on and may link to third parties, including Shopify, payment and financing providers, carriers, Waitwhile, Instagram, and WhatsApp. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services we do not control.

Disclaimers

Except for our authenticity guarantee and the commitments stated in these Terms and our Return and Shipping Policies, the Services and all pieces are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the website will be uninterrupted or error free. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

Limitation of Liability

To the fullest extent permitted by law, Starchive and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services or any purchase. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless Starchive and its owners, employees, and contractors from any third-party claims, losses, and reasonable legal fees arising from your breach of these Terms, your violation of law, or any item you submit to us that is not yours to sell or not as you described it.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in New York County, New York, and you and Starchive consent to their jurisdiction. If you are a consumer living outside the United States, you also keep any protections given to you by the mandatory laws of the country where you live.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the date at the top. Changes apply to orders placed and use of the Services after the updated Terms are posted.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with the policies they refer to, are the entire agreement between you and Starchive about the Services and replace any earlier versions.
